Mediation Pledge

The Mediation Pledge (Pacto de Mediação) reflects the commitment of its signatories to prioritize consensual mechanisms in addressing conflicts, such as mediation, conciliation and negotiation. By signing the the Pacto de Mediação, actors of various segments of the economy agree to adopt consensual methods of dispute resolution, in order to constantly improve the management of the disputes, in an efficient, collaborative, and sustainable manner.

 

Such initiative was first promoted by the International Institute for Conflict Prevention & Resolution (“CPR”) in the early 1980s, with great acceptance among various entities and companies willing to transform the way of dealing with their disputes.

Signing of the Pledge Mutual Recognition Agreement with CPR, on April 27, 2015:

 

On April 27, 2015, CBMA and CPR - a reference institution when it comes to alternative dispute resolution ("ADR") - entered into a landmark Mutual Recognition Agreement, which represented a major progress in the history of both institutions, solidifying their cooperation. In the agreement, CBMA and CPR agreed on reciprocity concerning the CPR 21st Century Corporate ADR Pledge©, the CPR Corporate Policy Statement on Alternatives to Litigation©, the CPR Law Firm Policy Statement on Alternatives to Litigation©, and the CBMA’s Pacto de Mediação, which together add up to thousands of signatories.

 

The signing of the Mutual Recognition Agreement is a fundamental milestone, especially considering that CBMA was the first Brazilian Mediation and Arbitration Center to implement their reciprocity and mutual cooperation with CPR. Besides CBMA, CPR has entered into similar agreements with the Centre de Médiation et d’Arbitrage de Paris (CMAP), Irish Commercial Mediation Association (ICMA), Camera Arbitrale di Milano (CAM) e Centre for Effective Dispute Resolution (CEDR).
